Terms of Service

1. Acceptance

These Terms of Service (“Terms”) govern your access to and use of Chatfill's website at chatfill.com and its product and APIs (together, the “Service”), provided by Synapse Software Pty Ltd (ABN 78 557 492 115), trading as Chatfill (“Chatfill”, “we”, “us”). By using the Service you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility and accounts

You must be at least 13 years old (or older if your jurisdiction requires) to use the Service. You are responsible for keeping your credentials secure and for all activity on your account. If you create an account on behalf of a business, you confirm you are authorised to bind that business to these Terms.

3. The Service

Chatfill helps you fill PDF forms by chatting with an AI assistant that asks the questions a form requires, uses your responses to populate the document, and lets you sign and download the result. Specific features, limits, and supported integrations may change over time.

4. Your content

You retain all rights to documents, chat messages, signatures, and saved memory you provide (“Your Content”). You grant Chatfill a worldwide, non-exclusive, royalty-free licence to host, copy, transmit, process, and display Your Content solely as needed to operate, secure, and improve the Service for you. You are responsible for Your Content and for ensuring you have the right to upload it.

5. AI output

Chatfill uses third-party AI models to generate questions, replies, and field values. AI output can be incorrect, incomplete, or biased. You are responsible for reviewing the filled form before signing, submitting, or relying on it. Chatfill does not provide legal, medical, financial, immigration, or other professional advice, and AI output is not a substitute for advice from a qualified professional.

6. Acceptable use

You agree not to:

  • Use the Service to violate any law or the rights of others.
  • Upload content you do not have the right to upload, or content that is unlawful, defamatory, infringing, or harmful.
  • Upload regulated data (such as protected health information, payment card numbers, or sensitive government identifiers) outside of an eligible Business plan that explicitly covers it.
  • Probe, scan, attack, or attempt to interfere with the Service or any other user's use of it.
  • Bypass authentication, rate limits, or any technical restriction.
  • Use the Service to build a competing product, or to extract its outputs to train another AI model.
  • Misrepresent yourself, impersonate others, or use the Service for fraud.

7. Plans, billing, and cancellation

Paid plans are billed through Stripe on the cycle shown at checkout. Fees are charged in advance and are non-refundable except where required by law. You can cancel a paid plan at any time from your account; access continues until the end of the current billing period, after which it is downgraded.

We may change pricing or plan features. Changes to recurring fees will take effect on a future billing cycle and we will notify you in advance. Continued use after the change takes effect constitutes acceptance.

8. Account suspension and termination

We may suspend or terminate your access to the Service if you breach these Terms, if your use creates risk for Chatfill or other users, or if required by law. You can stop using the Service at any time and delete your account from settings.

9. Third-party services

The Service relies on third-party providers (including a cloud infrastructure provider for hosting and authentication, third-party AI providers for chat and form-filling, Stripe for billing, Cloudflare for content delivery, and Google for sign-in). Your use of those services is also subject to their terms. We are not responsible for the acts or omissions of third parties.

10. Disclaimers

The Service is provided “as is” and “as available”. To the maximum extent permitted by law, Chatfill disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI output will be accurate or suitable for any particular purpose.

11. Limitation of liability

To the maximum extent permitted by law, Chatfill and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill arising out of or relating to your use of the Service. Our aggregate liability for any claim arising out of or relating to the Service will not exceed the greater of (a) the amounts you paid Chatfill in the twelve months before the claim or (b) one hundred United States dollars (USD 100).

12. Indemnity

You will indemnify and hold harmless Chatfill from any claim, demand, loss, or expense (including reasonable legal fees) arising out of (a) Your Content, (b) your use of the Service, or (c) your breach of these Terms.

13. Changes to the Service or these Terms

We may modify the Service and these Terms from time to time. If a change is material, we will update the effective date at the top of this page and, where appropriate, notify you in-app or by email. Continued use of the Service after the change takes effect constitutes acceptance.

14. Governing law and disputes

These Terms are governed by the laws of New South Wales, Australia, without regard to its conflict of laws rules. The courts of Australia have exclusive authority over any dispute relating to these Terms or the Service, except where applicable consumer law (including the Australian Consumer Law) gives you the right to bring proceedings in your local courts.
